ADC Seeks Urgent Supreme Court Ruling to Avoid Exclusion from 2027 Polls

The African Democratic Congress (ADC) has appealed to the Supreme Court of Nigeria for the immediate delivery of judgment in a pending case, warning that further delay could jeopardise its participation in the 2027 general elections.

In a letter dated April 28, 2026 and addressed to the Chief Justice of Nigeria, counsel to the party, S. E. Aruwa (SAN), said the appeal, marked SC/CV/180/2026, was heard on April 22, with judgment reserved.

The suit involves David Mark and others against parties including the electoral body, Independent National Electoral Commission (INEC).

The lawyers urged the apex court to deliver its ruling urgently, citing recent developments affecting the party’s leadership.

According to the letter, INEC, acting on a lower court judgment in Appeal No: CA/ABJ/145/2026, “purportedly removed or de-recognised the leadership of the ADC, leaving the party without leadership at the moment.”

The counsel warned that the situation poses a serious threat to the party’s ability to meet electoral requirements.

“The ADC’s ability to comply with statutory requirements to participate in the 2027 general elections is wholly dependent on the timely delivery of judgment in the appeal,” the letter stated.

It added that failure to deliver judgment within a short timeframe could have far-reaching consequences.

“Without the delivery of judgment within the next three days from the date of this letter, the ADC stands the grave and irreversible risk of being excluded from participating in the 2027 general elections,” the lawyers said.

They further argued that such an outcome would disenfranchise millions of Nigerians aligned with the party.

“This would deny them their constitutional right to freely associate and contest elections through a political party of their choice,” the letter added.

While acknowledging the workload of the court, the counsel stressed the urgency of the matter.

“We are mindful of the enormous responsibilities of this Honourable Court, but in this peculiar circumstance, justice delayed would amount to justice denied,” the letter said.

The ADC maintained that its political future and the expectations of its members nationwide now depend on the swift resolution of the case.
